REGULATIONS GOVERNING APPLICATION AND FEES ON DOMAIN NAMES

(Applicable to com.tw; org.tw; net.tw)

Amended on January 27, 1999

Article I:

Principle in application for Domain Names:

1. "First apply, first used" Principle.
2. The companies, firms, government agencies duly accredited and registered according to relevant laws of the Republic of China are entitled to apply. Individuals and unaccredited studios shall be governed by regulations which are to be separately established.
3. For change in Domain Names, application shall be duly filed according to the aforementioned principles.
4. In the event a foreign firm or organization holding no license issued by the Republic of China which intends to   apply for Taiwan area Domain Name (.tw), the application may be filed by its agent who shall submit documents as enumerated in Article V "Procedures for Domain Name Application."

1. edu.tw: Educational, academic and research organizations.
2. gov.tw: Government agencies.
3. com.tw: Commercial organizations (public and private business organizations).
4. net.tw: Internet management organization (holding Class II Telecommunication business licenses).
5. org.tw: Foundational, judicial persons and such non-government, nonprofit organizations.
6. mil.tw: National defense and military organizations.
7. Others.

1. The organizations authorized and accredited by the joint board of directors & supervisors of TWNIC, as per Appendix I, may entertain the cases of Domain Name registration and review.

1. Fees for Domain Name application are in two categories below:
2. Registration fee: NT$500, payable in one package upon application.
3. Annual fee: NT$1,000, with annual fees for two years payable in one package.
4. Registration fee shall be paid once more upon each change in Domain Name.
5. The Domain Name fee shall be non-returnable once registered. Under no reason shall the applicant apply for return.
6. An applicant is entitled to use the Domain Name for two years after paying registration fee and two-year annual fees. The Handling Organization will inform the applicant by E-mail 90 days prior to expiry, requesting the applicant to pay another two-year annual fee before the applicant becomes entitled to continually use the Domain Names.

Article V: Procedures for Domain Name application

1. Applicants are advised to take a straight access into application system at https://rs.twnic.net.tw and proceed with the procedures as instructed; or enter via various ISP (e.g., http://www.seed.net.tw, http://www.hinet.net, select "Domain Name registration system".
2. The applicant, after selecting "Domain Name Application", shall fill out the applicant's particulars and the applied Domain Name. In case of application via ISP on behalf, the agent shall additionally fill out the agent's data.
3. Send the required documents to the Handling Organization by mail or by FAX within fifteen days after filling the form out. Please refer to Appendix II for details of Handling Organization. The application documents:

1. The applicant's registration accreditation certificates in photocopies, e.g., profit-seeking enterprise certificate, social judicial person accreditation certificate.
2. Agreement to Domain Name application (Cf. Appendix III).
3. Class II Telecommunication Business License, photocopy, when applying for .net.tw. In case of use of .net.tw for academic research, the applicant may provide a letter along with net use plan in place of the Telecommunication Business License.
4. In the event a foreign firm or organization, which holds no license issued by the Republic of China, intends to apply for Taiwan area Domain Name (.tw), the application may be filed by its attorneys-at-law agent in Taiwan who shall submit such documents: 
5. The agent's registered accreditation certificate (profit-seeking enterprise certificate).
1. Power of attorney of the applicant.

1. Documents with introduction to the consignor, in Chinese.

2. The Handling Organization, after receipt of the applicant's application, shall proceed with review and inform the applicant by E-mail of the results.
3. In the event an application is objected because of nonconformity in terms, the applicant may, as instructed by the Handling Organization, make corrections and reapply.
4. The applicant, after receipt of the E-mail regarding approval of the application, shall pay required fees at TWNIC.
5. .If documents are not provided in full within fifteen days from application for registration at rs.twnic.net, the Handling Organization may revoke the application.
6. TWNIC may inform the Handling Organization to revoke the application if it does not receive required payment from applicant within fifteen days from issuing the notice of approval by E-mail. The payment procedures are shown in Appendix IV.
7. TWNIC shall, after confirming the receipt of required payment, issue the notice of approval by E-mail. The applicant, after receipt of the notice, may directly enter https://rs.twnic.net.tw to proceed with Host/IP operation.
8. Application procedures are shown in Appendix V.

1. The Handling Organization handles registration affairs and does not judge whether or not the registration and use of the Domain Name has infringed upon a third party's interests, does not get involved in litigation between the applicant and a third party nor does it act as a mediator.
2. In the event a Domain Name infringes upon a third party's interests (including infringement upon trademark, service badge, company name), the applicant shall indemnify the Handling Organization from all damages and losses so incurred (including damages to fame, manpower cost, litigious costs) and shall take all defensives on behalf.
3. The Handling Organization may change or revoke a Domain Name on grounds of a notice of court judgement or legally valid settlement.

1. In the event the fee is no longer paid after the paid annual fee expires, the Handling Organization will suspend the right to use for 90 days and will revoke the Domain Name if no payment is received upon expiry of the 90-day period.
2. The Handling Organization may revoke the Domain Name in case of violation of the declarations set forth in the "Agreement on Domain Name Application."
3. The Handling Organization may revoke the Domain Name pursuant to court judgement following litigation.
